Hi Robin,

I am a customer of Real NZ Tauranga X and thought I would ask if you will be updating it eventually??
It really needs an update at the moment and I wondered if I could provide you with pictures and everything would you consider updating it??
Obviously it's not something that happens over night but I thought I would ask?

I don't have any plans to update it. It is a fact of life that most airports are in a state of constant development, so any attempt to update regularly would be far too costly in time and money.
The only exception may be NZCH, since this is my home town, and it is undergoing a major upgrade while I'm working on it.

It hasn't changed that much anyways, slightly larger terminal, new aero club building, new classic flyers hanger and some sealed taxiways joining the concrete pads to the older taxi way at bayflight. Other than that its pretty much the same!

thats what i just said! its really not that different from the scenery, especially the movement area. I should know, im there every day!

Im not trying to argue with you goose but I fly aroud Tauranga roughly everyday and have spokon to others about this too. I know my stuff
Shame to hear that Robin, Would it breach your copyrights I tried to edit the scenery just for myself

The EULA for Tauranga states that you can't do this without my express permission, which you can have in this instance, provided this is for your own use.

Ahh, thank you Robin. That makes me feel better. Updating your FS9 RealNZ NZTG to what it is now, is something i did for my own personal use some time ago.........

The funny thing is, and no offence to Robin, that you (pilotgallagher01) or anyone else could have modified it for your own use without Robin being any the wiser. Provided that you didn't share it with anyone else, would anyone have been 'hurt'? It's not being very honest, but it happens a lot.

You own the CD/downloaded data, but you 'only' have the right to use it, not to modify it.

It would certainly be a lot easier if someone just asked me:)
I would be happy to consider all requests, but I wouldn't like to give anything but express rights on an individual basis, so you can't really assume anything here.
By the way Redkiwi is right -- generally your rights when purchasing software are restricted and clearly spelt out -- the idea that you can do anything you like with it, because you own it, can be very appealing, but of course this isn't the case. By that token, you could justify selling copies, simply because it is possible to copy the software -- clearly illegal and immoral, but there's always someone who is prepared to justify that.

Ok, good question then.

You can't consider ownership of software the same way as anything physical -- if you buy a car, for example, you could dismantle it the very next day and use it for parts in other vehicles. Lots of people do that. With software, though, 'dismantling' has a different meaning, in that the bits can be endlessly duplicated, without losing any quality. With software, the only physical component may be the CD or DVD is is supplied on, and whereas it is easy to visualise ownership of this, the data on the disc needs to be a lot further protected, hence the 'EULA', or license, which spells out your rights. The problems start when people start interpreting their rights in different ways, to get around the fact that the EULA doesn't really allow them to do what they want to do. Sure, you could do whatever you like in the privacy of your own home, but you will be in breach of the EULA. Of course this may not have any effect on me -- but you'd be surprised how many people re-interpret their rights so that they can give away or sell copies of my scenery, or dismantle it and use the bits for their own products.

So any developer would spell out your rights if they are selling their work. Basically, you can use my scenery in the way it was intended- one person, on one computer, within the confines of the simulator -- and no more. One of the EULA conditions is that you cannot 'dismantle' the scenery in any way. There are a lot of ways I could word the EULA, and I could in fact give the user a lot more rights, but it would cost more. You could in fact negotiate a new EULA which removes all restrictions, but it would cost you thousands of dollars.

That's why there are no 'implied' rights, and anything outside the EULA needs to be explicitly okayed by me.
