I don't think I'll post any more Google Earth background shots team .
I've been re reading the fine print , and i think ... even with the credits showing , they are illegal.
I'm just waiting to hear from the big "G" itself with regard to this , so in the meantime I'll just keep them to myself.
The last thing i want to do , is damage the reputation of this forum.

Seems to me, if you can right click on it and "save image" is available, it's public domain.

Charl , I'm not using the inbuilt Google Earth sim (which may have restrictions re distribution as well,) and i think thats where I get into a gray area . I'm using the "default" for lack of a better word Google Earth images , and adding an FSX image over the top.
But as Dave said , if you can save an image to file , it must be public to start with(because some you cant) . I'm not hiding the fact that these are GE based , in fact far from it , I'm happy to replace "pinpics" with the GE logo.
@Ian , there are no clouds in GE , you can select atmosphere , which gives a sky (daytime) and if not , then you get a night sky. The autogen is limited to whoever has added and textured the 3d buildings (otherwise its just flat), and with the big cities it seems to be just the downtown areas.
Im not sure if i will hear back from google , so in the meantime Iv'e decided to carry on and post a few until someone dobs me in , or i get the hard word.
Thinking it over , i doubt very much that the forum would be affected ... however, if any of you are opposed .... I'll stop it.

There's a guy over at the AVSIM screenshot forum, who posts shot after ad nauseam shot of photoreal scenery taken from 3,500ft.
No airports, nothing but photoreal scenery from the air.
One day I 'shopped a Cessna onto a GE picture and posted it as a riposte .
I felt somehow... dishonest.
